STARS Act Simplifies Affordable Care Act

Affordable Care ActWASHINGTON, D.C. - Sen. Ayotte (R-NH) along with Sen. King (I-ME), and Sen. Blunt (R-MO) introduced the "Simplifying Technical Aspects Regarding Seasonality" or STARS Act in the Senate- S.1809. The Senate STARS Act reflects H.R. 863, introduced mid-February in the House of Representatives. The legislation could to a certain extent simplify and streamline Affordable Care Act (ACA) compliance. This bill would modify the ACA to define a "seasonal employee" as a worker who is employed for six months or less during the calendar year.
 
Using this new definition, STARS would also remove these seasonal employees from the equation that determines to whom a covered employer must offer healthcare coverage or face a penalty. Under the STARS Act, large employers would not need to offer health insurance to seasonal employees who work less than six months during the year, in keeping with recent Treasury Department regulations.
