Federal Judge Halts the New Overtime Rule

On Tuesday, November 22, 2016, U.S. District Judge Amos Mazzant III in Texas found the the U.S. Department of Labor (DOL) exceeded its authority and issued a preliminary injunction halting implementation of the new federal overtime rule. The new rule was scheduled to take effect on December 1 next week.

The judge sided with plaintiffs who said the new overtime rules would cause an increase in costs to businesses in their states by making it mandatory for businesses to pay overtime to many heretofore exempt employees.

The DOL regulation was opposed by national PLNA counterparts, AmericanHort and the National Association of Landscape Professionals (NALP).

This judicial action gives the new Trump administration the opportunity modify the rule or scrap it completely when they take office in January.
