House Panel Approves H-2B Returning Worker Provision

WASHINGTON, D.C. – Last week the House Appropriations Committee agreed by voice vote to reinstate the H-2B returning worker provision in the Department of Homeland Security’s (DHS) appropriation bill. This provision could more than double the number of H-2B visas available to companies needing guest workers, including landscape contractors.

Good News, Bad News

That’s the good news. The bad news is it would only be in force for the next fiscal year beginning October 1, 2018. And the bill has long way to go before it is passed by the House and then goes to the Senate for action. Passage must come before September 30, 2018 to avoid a government shutdown.

Letter Helped

PLNA, AmericanHort and the National Association of Landscape Professionals (NALP) worked hard to get the provision in the bill. A coalition of landscape contractor associations and other businesses using guest workers was successful in getting a letter from 61 Members of Congress to House Appropriations Committee Chairman Frelinghuysen (R-NJ) and Ranking Member Lowey (D-NY) asking that a returning worker exemption be included in the FY 19 DHS Appropriations Bill. You may download a copy of the letter here.

Signing the letter were Pennsylvania Congressmen Scott Perry (R-York), Keith Rothfus (R-Allegheny), Glenn Thompson (R-Centre) and Lloyd Smucker (R-Lancaster).
