Mandatory E-Verify Bill Becomes Law without Governor’s Signature

E-Verify LogoHARRISBURG - A bill mandating the use of the federal E-Verify system for new workers in the construction industry became law without the Governor’s signature on October 6, 2019 (Act 75). The administration had opposed the bill, but it passed both houses of the General Assembly with veto-proof majorities. The bill will become effective in one year from the date of enactment, or October 6, 2020.

In PLNA’s discussions with the Department of Labor and Industry (L&I) and the Attorney General’s office, it’s clear that there is not yet a good understanding of the bill. L&I’s legislative director said they cannot give us a definitive answer at this point whether landscape contractors are covered under the bill. PLNA’s reading of the bill language indicates that there is a good chance that landscape contractors will be covered.

The L&I legislative director said that it will take them at least a month or more to review the bill and develop a full understanding of its implications. She also said that there is a possibility that the bill may never go into effect due to several lawsuits that L&I expects to be filed over the next few weeks.
